Eleventh Circuit declines to revive Carnival jacuzzi hatch lawsuit
The court found that the passenger did not establish that Carnival had constructive notice of the alleged danger during a 2024 cruise.

The Eleventh Circuit declined to reinstate a cruise passenger’s lawsuit against Carnival Corp. over an alleged fall involving a jacuzzi maintenance hatch aboard a 2024 sailing.
The passenger alleged that she fell down the maintenance hatch during the cruise. In rejecting the effort to revive the case, the court said she had failed to show that Carnival had constructive notice of the alleged hazardous condition.
The ruling leaves the passenger’s lawsuit against the cruise company unrestored. The Eleventh Circuit’s decision was based on the lack of a sufficient showing that Carnival had constructive notice of the danger alleged in the passenger’s claim, rather than a finding that such notice had been established.
